FIX TIME TERMS OF SERVICE & DISCLAIMER

1. General Information
FIX TIME ("Company," "we," "us," or "our") operates as an independent business providing high-quality home renovation, repair, and improvement services ("Services") in the state of Florida. By engaging with FIX TIME, accessing our Services, or utilizing any resources provided by us, you ("Client," "you," or "your") expressly agree to be bound by these Terms of Service ("Terms") in their entirety. If you do not agree to these Terms, you must immediately cease all use of our Services and refrain from engaging with FIX TIME in any capacity.

These Terms constitute a legally binding agreement between you and FIX TIME and govern your use of our Services. We reserve the right to modify, amend, or update these Terms at any time without prior notice. It is your responsibility to review these Terms periodically to ensure compliance with the most current version. Continued use of our Services after any modifications constitutes your acceptance of the revised Terms.

FIX TIME operates as a sole proprietorship or independent contractor without formal legal entity status. By engaging with our Services, you acknowledge that all agreements are made directly with the owner/operator of the business, and you agree to hold the owner/operator harmless for any disputes, liabilities, or legal actions related to the Services, except in cases of gross negligence or willful misconduct.

2. Scope of Services
FIX TIME offers a wide range of home renovation, repair, and improvement services, including but not limited to:

• General contracting services

• Structural repairs and modifications

• Cosmetic upgrades and remodeling

• Plumbing, electrical, and HVAC services

• Custom project work tailored to client specifications

All Services are provided on a project-by-project basis, and pricing is determined based on the specific requirements of each project. FIX TIME will provide an upfront estimate ("Estimate") for the proposed Services, which is subject to adjustment based on factors such as:

• Changes in project scope requested by the Client

• Unforeseen conditions or complications discovered during the course of work

• Fluctuations in material costs or labor rates

By accepting the Estimate, you acknowledge and agree that the final cost of the project may differ from the initial Estimate. FIX TIME reserves the right to adjust pricing accordingly and will notify you of any significant changes prior to proceeding.

3. Customer Responsibilities
As a Client, you agree to the following responsibilities:

1. Property Access: You must ensure that FIX TIME personnel have uninterrupted access to the property during scheduled work hours. Failure to provide access may result in delays, additional charges, or termination of the project.

2. Permits and Approvals: You are solely responsible for obtaining any necessary permits, approvals, or authorizations required for the project. FIX TIME is not liable for any delays, fines, or penalties resulting from your failure to secure the appropriate permits.

3. Property Condition: You warrant that the property is in a safe and suitable condition for the requested Services. FIX TIME is not responsible for pre-existing conditions, structural issues, or damage that may be discovered during the course of work.

4. Communication: You agree to maintain open and timely communication with FIX TIME throughout the duration of the project. Any changes to the project scope, timeline, or budget must be communicated in writing and agreed upon by both parties.

4. Payment Terms

1. Payment Methods: FIX TIME accepts payments in cash or via Zelle. Other payment methods may be accepted at our sole discretion and must be agreed upon in writing prior to the commencement of Services.

2. Payment Schedule: Payment is due upon completion of the Services unless otherwise agreed in writing. For larger projects, a deposit or progress payments may be required. Failure to make timely payments may result in a suspension of work or termination of the project.

3. Refunds: Due to the custom nature of our Services, FIX TIME does not offer refunds. However, we are committed to ensuring your satisfaction and will address any concerns or issues in a timely and professional manner.

5. Liability & Disclaimer

1. Limitation of Liability: FIX TIME strives to provide the highest quality Services; however, we are not liable for any damages, losses, or injuries arising from:

   • Unforeseen circumstances, including but not limited to structural issues, prior damage, or external factors beyond our control

   • Acts of God, natural disasters, or other force majeure events

   • Client negligence or failure to fulfill their responsibilities as outlined in these Terms

   • Additional repairs or modifications beyond the agreed scope of work

2. No Warranty: FIX TIME provides Services on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the quality, durability, or suitability of our Services for any particular purpose.

3. Indemnification: You agree to indemnify, defend, and hold harmless FIX TIME, its owner/operator, employees, and affiliates from any claims, liabilities, damages, or expenses arising from your use of our Services or your breach of these Terms.

6. Termination
FIX TIME reserves the right to terminate any project or refuse Service at our sole discretion, including but not limited to the following circumstances:

• Non-payment or late payment

• Client misconduct or failure to comply with these Terms

• Unsafe or unsuitable working conditions

• Discovery of pre-existing conditions that prevent the completion of the project

In the event of termination, you will be responsible for payment of all Services rendered up to the date of termination.

7. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms or our Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Miami, Florida, and the decision of the arbitrator shall be final and binding. By agreeing to these Terms, you waive your right to pursue claims in court, including class actions.

8. Miscellaneous

1. Entire Agreement: These Terms constitute the entire agreement between you and FIX TIME and supersede all prior agreements, understandings, or representations, whether oral or written.

2. Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

3. Waiver: No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
